WPS Websites Terms of Use

These terms of use, along with our Privacy Policy and other notices on our Websites, form the basis on which you may access and use our Websites.  We reserve the right to change any or all of our terms of use or other conditions for using our Websites at any time by publishing the new terms or conditions on our Websites.  Your use of our Websites constitutes your acceptance of those terms.  Should you object to any of our terms of use or other notices on our Websites your sole option is to immediately cease your use of the Websites.

Wine Preference Systems Ltd and its related entities responsible for maintaining our Websites and all its publications make no warranty as to the accuracy or reliability of the information contained therein (including, but not limited to, any content or information generated on our Websites by or on behalf of WPS, and any Third Party Content on our Websites) and WPS and its related entities, directors, officers and agents disclaim all liability and responsibility for any direct or indirect loss or damage which may be suffered by any recipient through relying on anything contained in or omitted from our Websites or publications.

Definitions

Agreement means these terms of use, the WPS privacy policy and any other terms incorporated by reference into these terms of use, in each case as amended from time to time;

Contributions means information including data, text, video, still images, audio or other material that you may save, sort and share on the Website as permitted under this Agreement.

Jeremy Oliver’s Tasting Room means the membership area of the Websites, which provides special features for a user.

Taste Tipper™ means the recommendation tool of the Website’s Tasting Room.

Marketing Partner Content means information including data, text, video, still images, audio or other material that WPS has permitted paid and unpaid advertisers to host, share, publish, post, store or upload on the Website.

WPS means Wine Preference Systems Pty Ltd and its subsidiaries.

Website means any website operated by WPS.

Restrictions on use of Websites

In accessing or using our Websites you agree that you will not:

1. use any automated device, software, process or means to access, retrieve, scrape, or index our Websites or any content on our Websites;
2. use any device, software, process or means to interfere or attempt to interfere with the proper working on our Websites;
3. undertake any action that will impose a burden or make excessive traffic demands on our infrastructure that we deem, in our sole discretion to be unreasonable or disproportionate site usage;
4. use any content on, or index our Websites for purposes of constructing or populating a searchable database of wines or wine tourism experiences and competing with us in any manner;
5. transmit spam, chain letters, contests, junk email, surveys, or other mass messaging, whether commercial in nature or not;
6. use our Websites or any content from our Websites in any manner which is, in our sole discretion, not reasonable and / or not for the purpose which it is made available;
7. violate the rights of any person, including copyright, trade secret, privacy right, or any other intellectual property or proprietary right;
8. pose as any person or entity or attempt to solicit money, passwords or personal information from any person;
9. act in violation of any Term of Use or other condition posed by us or any applicable law;
10. reproduce, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit our Websites or any content on our Websites, except as expressly authorised by us; or
11. transmit or attempt to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature.

We reserve the right to exercise whatever means we deem necessary to prevent unauthorised access to or use of our Websites, including, but not limited to, instituting technological barriers, or reporting your conduct to any person or entity.

Membership terms and conditions

Thank you for becoming a Guest or member of Jeremy Oliver’s Tasting Room.
With any contractual agreement, it is important that we outline the terms as simply and thoroughly as possible.  Please take the time to read this information carefully to avoid any confusion.  It is important that the terms of the contract between you and us are clear and for this reason, if there is any conflict between what is set out in this information and anything you have been informed through advertising or third parties, the terms in this contract will prevail.  Failure by us to enforce any of our rights at any time for any period shall not be construed as a waiver of those rights.

1. CONTRACT FORMATION

A contract arises between us once your have agreed to these terms and conditions by ticking the acceptance box at the bottom of this document.  This Contract will be governed by the laws of the state of Victoria in Australia.

2. MEMBERSHIP ENTITLEMENT

Your membership entitles you to use Jeremy Oliver’s Tasting Room and access the membership features for one year in accordance with these terms and conditions.

3. GUEST ENTITLEMENT

Your Guest membership entitles you to use Jeremy Oliver’s Tasting Room and access the membership features for seven days in accordance with these terms and conditions.

3. MINIMUM AGE

Membership is limited to persons who have reached or are older than the minimum legal age for drinking alcohol in their country.

4. ACCESS

You will be required to provide a membership number each time your access the Tasting Room. If you have forgotten your membership number, you may contact us and provide security details, so that we can re-issue another

5.SECURITY

You must ensure the security and confidentiality of your membership details, including any username and/or password assigned to you.  You are wholly responsible for all activities, which occur under your membership details (including unauthorised use of your credit card).  You must notify us immediately if you become aware of any unauthorised use of your membership details.  You must not permit your membership details to be used by or transferred to any other person.

6. MEMBERSHIP PROMISE

To provide quality recommendations and unique decision-making tools for members to purchase wine, wine travel and wine-related lifestyle products. 

7. MEMBERSHIP FEE REFUNDS

We provide a full refund in the event that we have not met or exceeded our Membership Promise.  This refund policy expires 7 days from the date that the membership was purchased.  We cannot provide a refund to members who received membership through a third party. 

8. COMPLAINTS

Please send your complaints to Wine Preference Systems Pty Ltd, ‘The Bakery’, 9 Reeve Lane, Canterbury, Victoria, Australia, 3126 or you may contact us by email.  We will respond within 3 working days.

9. CHANGE OF DETAILS

You must keep us informed of any change of email address and any other information relevant to your membership or products and services provided by Jeremy Oliver’s Tasting Room.

10. CONTRACT TRANSFER

We may assign or transfer the benefit of the contract, or sub-contract its obligations under it, to any person, firm or company at any time without notice to you but shall remain liable to meet our obligations to you under the Contract.

11. TERMINATION

We reserve the right to, in our sole discretion, suspend or terminate your membership or access to all or any part of Jeremy Oliver’s Tasting Room, including if we believe you are abusing the services in any way, have breached the Conditions or are no longer an active member.
